Directive 77-B: Proposal for Immediate Commencement of Punishment Upon Accusation

    • By commencing punishment immediately, the State demonstrates its commitment to swift accountability, minimizing disruption and reinforcing public trust in enforcement institutions.

Scope of Application

The directive applies universally, including but not limited to:

  • Administrative and Civil Infractions: speeding, public disorder, regulatory breaches.
  • Economic Violations: tax fraud, unlawful trading, financial misreporting.
  • Criminal Acts: assault, theft, corruption, immigration irregularities.

Compensation Protocols

Should judicial proceedings conclude in acquittal, the following reparations are to be issued:

  • Monetary Compensation: Payment equivalent to the median national wage per day of punishment served.
  • Status Correction: Official State certification of innocence, retroactively applied to all records.
  • Optional Adjustment: Supplemental moral damages at the discretion of the Compensation Bureau, budget permitting.

This ensures that no injustice persists beyond the duration of proceedings. The punishment is real, but so is the redress.

Implementation Sequence

  1. Immediate Custody: Upon formal accusation, the accused is transferred directly to assigned punishment (detention, fine, labor).
  2. Concurrent Adjudication: The trial is conducted while the accused is serving punishment.
  3. Final Determination:
    • Guilty → punishment continues seamlessly.
    • Not Guilty → immediate release and initiation of compensation protocols.
